HR Policy Joins Letters Supporting Repeal of ACA Taxes

The Partnership for Employer-Sponsored Coverage, of which the Association is a member, sent a letter to Congress endorsing bipartisan bills to repeal the ACA’s Cadillac tax on employer health care plans and the health insurance tax on fully-insured plans.

The letter expresses “strong support” for:

  • The Middle Class Health Benefits Tax Repeal Act (H.R. 748), which would repeal the Cadillac tax, which will impact more than half of employers by 2027; and

  • The Jobs and Premium Protection Act (S. 80), which would repeal the ACA’s direct tax on fully-insured carriers that is passed along disproportionately to small and mid-size employers.

Outlook:  Although the bills have broad bipartisan support, it is much more likely that both taxes will be further delayed than fully repealed, due to the impact full repeal would have on future federal tax revenue.
